Consumer Health Data Privacy Policy

Version 1.0 — effective 2026-09-17

DownSize Me — Consumer Health Data Privacy Policy

Version 1.0 — effective 17 September 2026

This is a separate policy, required by the Washington My Health My Data Act and Nevada's consumer health data law. It sits alongside, and does not replace, our Privacy Policy. Where the two differ in relation to health data, this one applies.

DownSize Me is operated by Kopfkino Entertainment Pty Ltd (ABN 30 652 854 263), trading as DownSize Me, 271 Brunker Road, Adamstown NSW 2289, Australia.

1. Who this policy is for

It applies to everyone, and it gives specific enforceable rights to residents of Washington State and Nevada. If you live in one of those states, the rights in section 6 are legal rights you can exercise against us, and Washington law also allows you to bring a claim directly if we get it wrong.

2. What we mean by consumer health data

"Consumer health data" means personal information that identifies your past, present or future physical or mental health status. For DownSize Me, that includes:

  • Body measurements — weight, goal weight, weight history, height, body measurements
  • Biometric and metabolic readings — blood sugar readings, ketone readings
  • Bodily functions and states — hunger levels, energy levels, motivation ratings, fasting windows, digestion and metabolic state indicators shown in the app
  • Diet and eating behaviour — meal times, logged meals and descriptions, meal photos, food preferences, dietary restrictions
  • Health conditions and treatment — any condition, symptom, diagnosis, medication or treatment you tell us or Coach G about
  • Conversations with Coach G — the full text of your chats, which frequently contain health information, and the summary "memory" derived from them
  • Health-related inferences — the plan, phase, pace and meal schedule we derive from the above, and progress calculations such as streaks and weight change
  • Health-related community content — posts, comments and photos you choose to share, including when posted anonymously

3. Where we get it

From you, directly — typed into the app, spoken to Coach G, or uploaded as a photo. Some data is derived by us from what you enter (for example, calculating your fasting window or your plan phase).

We do not buy consumer health data, and we do not obtain it from data brokers, advertising networks, or third-party trackers.

4. Why we collect it

We collect consumer health data only to:

  1. build and adjust your personal fasting and meal plan
  2. show you your own progress, history and streaks
  3. let Coach G give you relevant, personalised responses
  4. show you content and lessons relevant to your plan
  5. display content you have chosen to post to the community
  6. improve Coach G's quality and safety, through review by our team
  7. keep the service secure and working, and meet legal obligations

We do not use consumer health data for advertising, profiling for marketing, or any form of targeted advertising.

5. Who we share it with — and who we do not

We do not sell consumer health data. We do not accept payment or anything of value in exchange for it. We will not do so without a separate, specific written authorisation from you, which we currently do not seek and have never obtained from anyone.

We share consumer health data only with service providers ("processors") who need it to run the app, under contracts that forbid them using it for their own purposes:

Category of recipientWhat they receiveWhy
Application hosting and database providerAll app data, including health dataStores your records
Authentication providerEmail address and account identifiers only — no health dataLogin and password reset
AI model providerYour Coach G messages and the health context needed to answer themGenerates Coach G's replies
Payment processor (Stripe)Billing email and subscription status only — no health dataTakes payment
Email delivery providerEmail address and message content, which may reference your planSends account and plan emails
Error and performance monitoringTechnical logs, which may incidentally contain health dataFinds and fixes faults

Our own team — currently the operator of DownSize Me — can access consumer health data, including Coach G conversations, for support, safety and improving Coach G. Access is limited to what is needed.

Other members can see only what you deliberately post to the community.

We may also disclose health data if legally compelled, or to prevent serious harm to someone's health or safety.

6. Your rights over your consumer health data

You have the right to:

  1. Confirm whether we are collecting, sharing or selling your consumer health data.
  2. Access it, including a list of all third parties with whom we have shared it, and an active contact for each of them.
  3. Withdraw your consent to our collection and sharing of it.
  4. Delete it — including from our live systems and, as backups expire, from backups. We will also instruct our processors to delete it.
  5. Not be discriminated against for exercising any of these rights.
  6. Appeal if we refuse a request.

How to exercise them

Email support@downsizemejourney.com from your account's email address, saying which right you want to use. You can also request deletion from your profile settings in the app, or by emailing support@downsizemejourney.com, and the data described in this policy is then deleted on the timeframes set out below.

Our timeframes:

  • we acknowledge and respond within 45 days
  • if we genuinely need longer, we may extend by a further 45 days and will tell you why within the first 45
  • deletion: we delete from live systems within 30 days of confirming your request, notify our processors to do the same, and remove it from backups as those backups expire (within 30 days)
  • appeals: reply to our decision and we will review it within 45 days and give written reasons

If we deny your appeal, you may complain to the Washington State Attorney General (at atg.wa.gov/file-complaint) or, in Nevada, the Nevada Attorney General. Australian users may complain to the Office of the Australian Information Commissioner (oaic.gov.au).

What deletion actually costs you: deleting your consumer health data removes your plan, history, progress and Coach G's memory of you. It cannot be undone, and it effectively ends your ability to use the app as intended. We will say so plainly before we act, but we will act.

7. Consent

Before we collect your consumer health data, we ask you to agree to it — separately from agreeing to our Terms, and separately from consent to share community content. We record which consents you gave, when, and the version of this policy in force at that moment.

Your consent is not bundled: you can accept the app's Terms and still refuse health-data processing (though the app cannot then give you a personalised plan). We do not treat refusal to consent as permission to proceed.

8. Employees and job applicants

This policy covers members and visitors. It does not apply to information we hold about employees or contractors in that capacity.

9. Changes to this policy

If we make a material change to how we handle consumer health data, we will notify you and obtain your consent again before applying it to data we already hold. Each version is numbered and dated, and we record which version you accepted.
